| 7 | Divorce Records between Monroe Smith and Mary Jane Todd Smith Sometime in late 1906 or early 1907, when the weather was cold, Mary Jane Todd Smith and her three children packed what belongings they could into toe sacks and left her husband, Monroe Smith, in Limestone County, Alabama. For a more detailed description, see the notes under Goldie Lee Smith Brown, daughter of Monroe Smith and Mary Jane Todd Smith. This narrative was told to Tony Pope by his grandmother, Goldie Lee Smith Brown. Goldie remembers snow being on the ground at one point and her baby sister, Viola, had not been born yet. Tassie, Goldie's half-sister, wanted to stay home from school like her sisters, but her stepmother sent her on to school. Approximately six years later in 1913, Monroe begins divorce proceedings. Probably in order to marry his third wife, Okalonie Lewis. The notes below were compiled using records obtained from the Limestone County Archives in Athens, Alabama. February 13, 1913: Chancery Court records for the Fifth District of Northern Chancery Division at Athens, Alabama in Limestone County commands any sheriff in the State of Alabama to summon Mary Smith to appear and plead to, answer or demur, within thirty days from the service hereof… A typed note at the end of this document states… “Defendant lives with Mr. John Todd, Albertville, Alabama, Route, No. 1, 16 miles from said town.” April 28, 1913: Typewritten letter to Monroe Smith of Madison, Alabama from Register in Chancery states: “The suit filed in this Court by your attorneys for divorce has been dismissed and a new suit filed; this had to be done because the Sheriff could not [find?] Mrs. Smith to serve the notice on her; now a non-residence notice will need to be published in the newspaper in order to get notice on her. Your attorneys wrote me to write to you for the costs in the case that has been dismissed, and this will have to paid before I can file the other case; it amounts to $3.60, and I shall appreciate it if you will kindly send me check or money order for this sum, and upon receipt of same I shall then file the other suit and issue the notice. This is the cost that has accrued in the case that is to be dismissed, and has nothing to do with the other suit.” May 06, 1913: Chancery Court document stating that Mary Smith is a non-resident of Alabama, and that her particular place of residence is unknown orders that a publication be made in the “Limestone Democrat”, a newspaper published in the town of Athens, Limestone County, Alabama, be made once a week for four consecutive weeks to plead, answer, or demur to the bill of complaint in this cause by 06 June 1913 or thirty days thereafter a decree pro confesso may be taken against her. May 08 -29, 1913: A clipping published in the “Limestone Democrat” newspaper for four consecutive weeks states: “Non-Resident Notice: The State of Alabama, Limestone County. In chancery, at Athens, fifth district, northern chancery division. Monroe Smith, 1051 vs. Mary Smith. In this cause, it is made to appear to the register, by the affidavit of Monroe Smith, that the defendant, Mary Smith is a non-resident of the state of Alabama, and that her particular place of residence is unknown and further, that in the belief of said affiant, the defendant is over the age of twenty-one years. It is therefore ordered by the register that publication be made in the Limestone Democrat, a newspaper published in the tow of Athens, County of Limestone, state of Alabama, once a week for four consecutive weeks, requiring her the said Mary Smith to plead, answer or demur to the bill of complaint in this cause by the 06 day of June 1913, or, in thirty days thereafter, a decree pro confesso may be taken against her. Done at the office, in Athens, Ala, this 06 day of May, 1913. W.W. Malone, Register.” July 18, 1913: A handwritten note on letterhead from the Law Offices of Walker and Spragins [Richard W. Walker & Robert E. Spragins] of Huntsville, Alabama asks the Chancery Court in Athens, Alabama if the divorce case between Monroe Smith and his wife [Mary Jane Todd Smith] has been filed. The note continues that the time is up, and requests a decree pro confesso so they can take the proof. Signature at the bottom is “Spragins Speake.” July 26, 1913: A typewritten note on letterhead from Spragins & Speake Attorneys at Law, First National Bank Building; Huntsville, Alabama is sent out by Robert E. Spragins. To the Register in Chancery, Athens, Alabama, the note states: “Dear Sir: I wrote you a week or ten days ago to know if the time had expired for the taking of a decree pro confesso in the case of Monroe Smith against his wife for divorce. Since writing you I have heard nothing. I am in receipt of information from Mr. Monroe Smith that the time has expired. If so please take a decree pro confesso on day after tomorrow, if you have not already don so and notify me to this effect. I will send you interrogatories to be filed to Joseph Lewis and Wm. Anelton, witnesses for complainant in the case and will ask that you issue a commission to yourself to take the depositions. Both witnesses live in the south part of your county.” July 28, 1913: Proof of Publication from W.W. Malone, Register in Chancery in Limestone County, Alabama, document certifies that a notice was placed in the “Limestone Democrat” newspaper commencing 08 of May 1913 and ending 29 of May 1913. Copy of article included. July 28, 1913: Decree Pro Confesso on Publication taken before Chancellor, Court or Register document states that no reply was received from Mary Jane Todd Smith after publication of notice in the “Limestone Democrat” newspaper for four consecutive weeks from 08 May 1913 through 29 of May 1913. August 06, 1913: A typewritten note from Robert E. Spragins to Mr. W.W. Malone, Register in Chancery, Athens, Alabama states: “I am handing you herewith interrogatories to be filed in the case of Monroe Smith vs. Mary Smith, nominating you as Commissioner to take the depositions. Please advise Mr. Monroe Smith, Madison Alabama, R.F.D. #…c/o Ms. W.A. Whitmo..? [in care of is handwritten an cannot read entire name]…what you will expect from him and his two witnesses to come before you on a certain day fixed- set you time after the lapse of ten days from the filing of the interrogatories.” A handwritten notation at the bottom states: “Wrote to Smith 8/8/13.” August 09, 1913: Typed letter from Spragin and Speake, attorneys representing Monroe Smith in divorce case against Mary Jane Todd Smith, goes to the Chancery Court in Limestone County, Alabama. Document states questions (interrogatories) to be given to two witnesses and to Monroe Smith when giving depositions to be read in evidence at divorce trial. Witnesses for Monroe Smith are Joseph Lewis and Henry Smith. Henry Smith's name is handwritten over William Anelton whose name has been marked through. Questions to be asked will be included with statements. August 13, 1913: Commission Caption and Certificate document, gives information stating that W.W. Malone, Register of Chancery Court of Limestone County, Alabama has called Joseph Lewis, Henry Smith, and Monroe Smith to appear before him on August 19, 1913 August 19, 1913: Joseph Lewis, Henry Smith and Monroe Smith give statements to W. W. Malone, Register of Chancery Court of Limestone County, Alabama. This information has been typewritten onto Commission Caption and Certificate document sent out on August 13, 1913. Statements given: My name is Monroe Smith, I am the complainant in this cause, I am over 21 years of age, I live in Limestone County, Alabama, and have lived here all my life, and I am 45 years of age; the defendant Mary Smith is over 21 yeas of age, and I do not know where she lives, and have not heard from her and have not seen her for seven years. Yes Sir, -- Mary Smith and I were married in Limestone County, Alabama, about 16 years ago. I do not live with my wife now, I do not even know where she is. Yes Sir, -- she voluntarily abandoned me without any fault on my part; this took place in Limestone County, Alabama, more than three years ago, in fact about seven years ago; I was working about ten miles away from home and when I went back home on Saturday night I found her gone, and I have not seen her since that time. *Apparently Monroe could not write so he left an “x” beside his name that someone else wrote. I, Henry Smith live in Limestone County, Alabama, and I, Joseph Lewis live in Morgan County, Alabama near Trinity and I have lived there for about a year; I Henry Smith have lived in Limestone County, Alabama all my life; We both know the parties to this suit, and have known them about 25 years or long. Mr. Monroe Smith resides in Limestone County, Alabama, and we do not have any idea where the woman, Mrs. Mary Smith resides. Mr. Smith has resided in Limestone County all his life. We know that it has been a long time, about 15 or 16 years ago, that they married and in this county and state. They lived together as man and wife for nine or ten years. No Sir, they are not now living together. They separate about 7 years ago; we were working with Mr. Smith at this time about ten miles from home down on the River, and we went home with him on a certain Saturday night and when we got there we found that Mrs. Mary Smith was not there, and we were informed that she had left and we have not seen or heard of her since that time. Yes Sir, -- one of them did abandon the other; Mrs. Smith abandoned Mr. Smith, and abandonment occurred about 7 years ago, and in this country and state, an it has been continuous up to this time. Yes Sir, --the abandonment was complete from bed and board, and the abandonment was not the fault of Mr. Smith. *Apparently Henry Smith could not write so he left an “x” beside his name that someone else wrote. Joe [Joseph] Lewis signed his name. September 01, 1913: Decree of Divorce document from Limestone County in the State of Alabama grants decree pro confesso and dissolves marriage of Monroe Smith and Mary Jane Todd Smith on grounds of “voluntary abandonment.” NOTES: Even though the first document dated February 13, 1913 indicated where Mary Jane Todd Smith was living at the time, it is evident from the documentation following it that the whereabouts of Mary Jane was not known for some time, possibly not until after the divorce which was granted on September 01, 1913.
